They proved the legality of the will of a testator with a psychiatric illness

K&P.Group's client received a testamentary inheritance from her mother, including an apartment in central Moscow.

The testator's adult son was not mentioned in the will. He decided to challenge the document in court because his mother had been suffering from a psychiatric illness for many years, was registered and had a disability.

We collected medical documents from different clinics and from doctors in various fields. When examining the patient, all specialists recorded that she was in a clear condition. Witnesses were called and spoke about many years of communication with the testator. They explained that they did not notice any deviations. They presented evidence that despite her disability, the testator received additional education and worked.

The evidence collected became the basis for the conclusion of a posthumous psychiatric examination, which showed that the testator understood the significance of her actions.

The court upheld the will drawn up by a testator with a psychiatric illness.
