After the divorce, the two children stayed with their mother. After a while, she remarried and planned to move to another city. But the thirteen-year-old son did not want to leave, and he also had a bad relationship with his stepfather.
The boy's father went to court to determine the place of residence of his son and his daughter's place of residence with his mother. Two authorities refused.
Then the boy moved in with his own father on his own. This led to new problems: the mother regularly reported her son's kidnapping to the police, refused to hand over the child's documents (including from school) and prevented him from being transferred to a new educational institution. And when law enforcement agencies visited his father, the boy explained that he had moved of his own free will and did not want to return to his mother.
Lawyers have developed a strategy for my father to communicate with law enforcement agencies, educational institutions, and guardianship authorities. We prepared a statement of claim to determine the child's place of residence. They presented evidence in favor of the boy's residence with his father, including the opinion of a psychologist.
The court recommended concluding an amicable agreement. The parties agreed that the child lives with his father until the age of 16, and then chooses his own place of residence.
