How K&P.Group Law Firm Protected Russian Infobusiness
Content
A few years ago, a popular blogger Christina Sophie registered the “Warm-up” trademark.
An information producer contacted K&P.Group and considered this action illegal. The client insisted that the word “warm up” is common among bloggers and information businessmen, many of whom are launching their own warm-up training.
The complexity of the case was that online infobusiness courses change every year, so it is quite difficult to collect evidence by a specific date.
Anna Molchanova, lawyer, head of IP practice at K&P.Group and patent attorney, as well as lawyer Kristina Timofeyeva, took up the case. They were able to prove that:
- the word “warm-up” began to be used by other people long before the date of registration of the trademark;
- Christina Sophie, as an information business representative, could not help but know about the active use of the warm-up technique by other bloggers;
- The blogger's actions are aimed at gaining advantages over other market participants.
In the summer of 2023, K&P.Group experts appealed to the Krasnodar Office of the Federal Antimonopoly Service to recognize the registration of the Progrev trademark as an act of unfair competition.
The state body agreed with the requirements and admitted that Christina Sophie's actions violate Part 1 of Article 14.4 of the Federal Law “On Protection of Competition”.
This decision plays an important role for infobusiness. Now the word “warm up” will again be available for free use by bloggers.
