We protected the manufacturer from the competitor's unfair behavior

The client contacted K&P.Group to remove similar packaging from the market and prevent the redistribution of consumer demand in favor of a competitor.

The K&P. Group team has developed a protection strategy:

• filed an application to the Federal Antimonopoly Service to recognize the competitor's actions as unfair;
• filed a lawsuit to declare the competitor's packaging illegal processing of the design object and recover compensation in the amount of twice the cost of the right to use.

Lawyers proved that the competitor actively used similar packaging, and the product became famous among consumers who confused it with the client's products. For this purpose, expert opinions and the results of sociological research were presented, as well as evidence of losses. The FAS found that the competitor acted in bad faith.

The court recovered damages in favor of K&P. Group's client.
